By accessing or using Momentify ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service. These terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Momentify provides AI-powered tools and features to analyze video and audio content, generate transcripts, extract "aha moments," and assist in content creation. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice or liability.

3. User Accounts & Responsibilities

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms.

• You are responsible for safeguarding your password.
• You agree not to disclose your password to any third party.
• You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
• You may not use the Service to process illegal, copyrighted (without permission), or harmful content.

4. Subscriptions and Payments

Certain parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis depending on your subscription plan. Payments are non-refundable except when required by law or explicitly stated in our refund policy.

5. Limitations of Liability

In no event shall Momentify, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service; and
• Unauthorized access, use or alteration of your transmissions or content.
